Overview:  Emergency Case LLC (the “Company”) recognizes and respects the privacy of users of our website,www.emergencycase.com (the “Website”).  The following privacy policy, as modified from time to time by the Company and as described below (the “Policy”), advises you about the information that the Company collects through the Website, how we use that information and how you can opt out of certain uses of information we may collect.  If you access the Website you are consenting to the information collection and use practices described in this Policy, as modified from time to time by us.

Effective Date and Updates:  The Company reserves the right to make changes to this Policy at anytime, and will post any revised Policy on this page.  This Privacy Policy is effective at 6:00 p.m. on August 31, 2016.  The Company will not notify its Website visitors or customers of any such changes by e-mail or other personal contact.  We encourage you to check the date of this Policy whenever you visit this Website so that you will know when you need to review the Policy for modifications.  Please note that this Policy applies to all information collected online by the Company, but does not apply to information that may be collected by third party websites that may be accessed by links in our website, each of which have their own privacy policies.

Information the Company May Collect About You:  The following is a list of items we collect on the Website:

  • Personal Information is information that is used by the Company to identify you individually, such as your name and address, telephone and email address. Information provided to us will be protected and kept confidential among the Company. and its affiliated companies in agreement to the Privacy Policy. With your permission, your personal information may be collected by the Company for the purpose of being able to communicate with you pertaining to related products, services, promotional events or contests.
  • Aggregate Information is information that does not contain Personal Information or from which Personal Information has been removed.  For instance, the Company may collect various forms of “click stream” information such as entry and exit points for our Website (i.e., referring URLs or domains), site traffic statistics, page views, impressions, and operating system and browser type.  In addition, when users request pages on the Website, the Company’s servers automatically log the users IP address.  An IP address is a number that is automatically assigned to your computer whenever you are surfing the Web.

Any such transfer shall be under strict confidentiality and security obligations and for the sole purpose of the performance of those obligations. When users voluntarily register with the Website or  contact  the Company, personal information will be collected in order for users to receive newsletters, new product launch information, special events information or to answer surveys, enter contests and receive notices of promotional opportunities. Information provided by you to create a personal customer profile will be used in order to receive notice of products, services or events that may be of interest to you. If you sign up to receive information from the Company but later decide that you no longer want to receive such, you may contact the Company at any time to cancel any option.

Unsolicited Materials: To present you with the best service, Emergency Case requests that you provide certain information  through the Site – including questions and comments pertaining to Emergency Case products, services or event. Received Unsolicited Materials, including but not limited to business, advertising, creative, marketing or any other types of proposals, concepts, know-how, ideas and the like will not be subject to this Privacy Policy and the Company  shall have no obligation to return any Unsolicited Materials received. By submitting any Unsolicited Materials, you agree that the Company shall have the sole discretion as to how to utilize such Unsolicited Materials  By submitting any Unsolicited Materials, you automatically agree and administer Emergency Case a perpetual, royalty free license to use and exploit the Unsolicited Materials. If any Unsolicited Materials that you have submitted to the Company are protected by third party copyright, trademark or other proprietary rights, you agree to indemnify the Company  against any claims or actions filed against the Company, relating to the Company’s use or possession of the Unsolicited Materials.

Outside Links:  A link from the Website to such a third party website does not imply endorsement of that site nor any ability to control that site’s privacy practices.  Be aware that third party websites may collect data and personal information and operate according to their own privacy practices.  Therefore, you should carefully review the privacy policies of third party websites before submitting any Personal Information to them.

Breach of Security:  In the event of a breach of our information system security that may compromise your personal financial information, we will promptly notify you of such breach at the e-mail address that we have on file for you.  We reserve the right to reasonably delay such notification as may reasonably be necessary as part of any internal investigation or law enforcement efforts related to such breach.  To respect the privacy of children and to comply with the Children’s Online Privacy Protection Act, we do not knowingly provide products or services to children under the age of 13.  The Website is a general audience site that is not designed nor intended to collect personal information from children under the age of 13.  If you are under 13 years old, you should not request any information nor provide any Personal Information to the Website.

Governing Law:  The internal laws of the State of California, without reference to any choice of law provisions, shall govern any claims relating to the Policy.
